General Rental Terms and Conditions

These General Terms and Conditions govern the contract for the rental of vehicles (scooters, mopeds and other vehicles) between GOTTARDO GROUP ITALY S.r.l.s., owner of the "Gottardo Scooters" brand (hereinafter "the Lessor"), and the customer (hereinafter "the Driver"). By making a booking, the Driver declares that he/she has read and fully accepted these terms and conditions.

1. Subject matter and identity of the Lessor

The rental service is provided by GOTTARDO GROUP ITALY S.r.l.s., VAT no. 14722830966, with registered office at Viale Leone Tolstoy, 66, 20146 Milano (MI). The pick-up and drop-off point for the vehicles is located in Diano Marina (IM).

The rental contract is concluded upon confirmation of the booking and payment in accordance with the procedures set out in the following articles.

2. Driver requirements

In order to rent and drive the vehicles, the Driver must meet the following requirements, which will be verified at the time of pick-up by presenting valid original documents:

  • Minimum age of 18 years completed;
  • A valid driving licence suitable for the category of the rented vehicle (AM/A1/A2/A/B depending on the vehicle), valid and held for at least one year;
  • A valid identity document;
  • For non-EU citizens, an international driving permit or a sworn translation where required by Italian law.

3. Booking and confirmation

Bookings are made online via the website or at the rental point. For the purpose of the mandatory issuance of the invoice, the Driver is required to provide complete personal details (first name, surname, address, tax code and/or VAT number) before payment.

Vehicle availability is guaranteed only once the booking is confirmed. In the event of subsequent unavailability of the booked model, the Lessor may offer an equivalent vehicle or proceed with a full refund.

4. Prices, payment and invoicing

Prices are expressed in Euro and include VAT. The rental rate is calculated on the basis of the model, the duration and the selected ancillary services.

As a limited liability company, the Lessor issues an invoice for every rental: invoicing is not optional. For this reason, the Driver’s complete personal details are required at the booking stage.

5. Deposit (security deposit)

At the time of pick-up, a security deposit is required to cover any damage, penalties or shortfalls. The deposit may be provided by pre-authorisation on a credit card / PayPal account or in cash, according to the amount indicated for the vehicle category.

The deposit is released, or refunded if paid in cash, at the end of the rental after verification of the condition of the vehicle and the absence of penalties or damage attributable to the Driver.

6. Delivery and return

Pick-up and return take place at the rental point in Diano Marina. A home delivery and collection service is available.

Home delivery is free within the Municipality of Diano Marina (postal code 18013). For addresses outside the Municipality, a premium service is provided at an additional cost indicated at the booking stage.

The vehicle must be returned in the same condition in which it was delivered, except for normal wear and tear. Delays in returning the vehicle may result in additional days being charged.

7. Ancillary services

The following paid ancillary services may be added to the rental upon request:

  • Helmet for passenger;
  • Smartphone holder;
  • Home delivery/collection outside the Municipality;
  • Night-time pick-up;
  • Authorised second driver.

8. Second driver

It is possible to authorise a second driver, who must meet the same requirements set out in Article 2 and be registered before the start of the rental. Only authorised and registered drivers may drive the vehicle.

9. Use of the vehicle and Driver obligations

The Driver undertakes to:

  • Use the vehicle with care and in compliance with the Highway Code;
  • Always wear a helmet, both his/her own and that of any passenger;
  • Not drive under the influence of alcohol or narcotic substances;
  • Not sublet, transfer or transport the vehicle outside the national territory without written authorisation;
  • Not use the vehicle for races, competitions or unlawful purposes;
  • Safeguard the vehicle and use the anti-theft devices provided.

10. Insurance and liability

The vehicles are covered by mandatory third-party liability insurance. Any additional coverage (excess reduction, theft/fire) may be selected at the booking stage.

The Driver is liable for damage not covered by the insurance, applicable excesses, administrative penalties and any breach of the Highway Code committed during the rental period.

11. Breakdowns, accidents and theft

In the event of a breakdown, accident or theft, the Driver must immediately notify the Lessor and, where applicable, the competent authorities, completing the accident report form and, in the event of theft, filing a formal report.

In the event of an accident for which the Driver is responsible, or of theft due to negligence (e.g. failure to use the anti-theft devices), the costs provided for in the contract and by the excesses may be charged.

12. Fuel

The vehicle is delivered with a specific fuel level and must be returned with the same level. Otherwise, the missing fuel will be charged together with any service fee.

13. Cancellations and refunds

The applicable cancellation policy is as follows:

  • Cancellation up to 48 hours before the start of the rental: 100% refund;
  • Cancellation between 48 and 24 hours before the start: 50% refund;
  • Cancellation with less than 24 hours’ notice or failure to show up (no-show): no refund.

14. Changes to the booking

Requests for changes (dates, model, services) are subject to availability and may result in a price difference. Changes must be requested with reasonable advance notice before the start of the rental.

15. Limitation of liability

The Lessor shall not be liable for indirect or consequential damages arising from the unavailability of the vehicle or the interruption of the service due to causes beyond its control (force majeure, adverse weather conditions, measures by the authorities).

16. Processing of personal data

The Driver’s personal data are processed in compliance with Regulation (EU) 2016/679 (GDPR) as set out in the Privacy Policy available on the website.

17. Applicable law and place of jurisdiction

This contract is governed by Italian law. For any dispute, the court of the place of residence or domicile of the consumer shall have jurisdiction, where consumer protection legislation applies; in all other cases, the competent court shall be that of the Lessor’s registered office.
